The PCA Board of Directors meets at 7:00 p.m. on the fourth Thursday of every month at 1001 Pineloch, Suite 100 (the old Sterling Bank Building in the strip center at the corner of El Camino and Pineloch). All Pineloch residents are welcome to attend any meeting. Residents may directly address the Board regarding any community issues at the outset of every meeting; there is no need to be placed onto the agenda in advance.
We would like to have you participate in a survey of the community to help provide guidance to your Board. While the Board consists of five individuals from different parts of the community who were elected by you in the democratic elections at our annual meetings, that does not mean the Board members always know everything the community wants or needs. To be responsive to your needs, we seek your input with a survey of interests. Note that the survey ends on January 1st. At the January 28th Board meeting we shall have a drawing from the surveys received and will award one property owner a $200 prize for completing the survey. Cat Found Near Walgreens
We found a kitten/teen cat wandering around the parking lot of the gas station near Walgreens. It is on the thin side -- was very hungry -- and is wearing a collar. No tags on the collar but sure he/she belongs to someone. We can be reached at 832-205-0306 or through email.

Statement From City Of Houston Regarding Biodegradable Yard Waste Bags

Subject: Biodegradable Bags
My office has made me aware that the Chronicle ran an ad/notice inappropriately stating that the City of Houston would begin requiring biodegradable yard waste bags effective January 1, 2010. This statement is not true. Apparently, the Chronicle used old information based on the passage of updates to chapter 39 (in September) when we targeted January 1 as a proposed implementation date.
Both the outgoing and incoming administrations have been advised that the 1st quarter of 2010 is when we would like to do this, i.e., we have until the end of March to get more hosting stores with enough bags available in sufficient locations. We do know that most of the grass collected occurs in only a few portions of the city, so it is imperative that we have adequate supplies in those store areas.

League City Charter Chapter Of ABWA Will Meet On January 21

Please join the members of the League City Charter Chapter of American Business Women's Association on Thursday, January 21, 2010 at 6:30 p.m. The meeting will be held at a new location: Sundance Grill II, 800 Mariners Drive, Kemah (phone: 281-535-5350). We will have the business meeting and a motivational speaker, to be announced based on confirmation of schedules. The social networking will begin at 6:30 pm. At 7:00 pm, a special menu will be prepared by Sundance Grill, and our guest speaker will appear. Business will conclude at 8:30 pm. Meeting and Dinner are $20 per person for members and guests.
The American Business Women's Association, League City Charter Chapter, is a group of career-minded professionals who support the goals of the organization. The League City Charter Chapter meets on the third Thursday of every month. We have been meeting at the South Shore Country Club, but with a major remodeling project at the Country Club for the next few months, the meeting place has changed to Sundance Grill II.
We are looking forward to 2010 and want to see our chapter grow in numbers and stature. . Please join us and see if this great organization of business women is a fit for you and your goals for 2010!

Deed Restriction Amendments Results
On Saturday, October 31, the Pineloch Community considered proposed amendments to the Declaration of Covenants that are the primary governing documents of the community. This event was held in response to community members who had approached the Board requesting changes in the deed restrictions relating to roof colors and fence heights.
The amendment process for the Covenants is found in Article VIII, Section 3 of the Covenants, and is posted on the association's website. The Covenant amendment process requires that for an amendment to be made to the Covenants, 75% of the members of the association must sign a document indicating that they support the changes. The Covenants cannot be amended by the Board or by any other process.
Some of the homeowners contacting the Board requesting the changes were persons who had put in roofs or fences that violated the current deed restrictions. Others expressing support included persons who were interested in doing something different but did not want to violate the deed restrictions. The Board was sensitive to the views expressed by these homeowners, but at the same time the PCA Board is charged with the enforcement of our deed restrictions. The Board cannot selectively choose which deed restrictions to enforce and ignore, just as it cannot selectively enforce the deed restrictions at one home and not at another. So given the deed restrictions in the Covenants, the Board had no options before it.
Through direct Board contact and through the property management firm that works for the association, the Board encouraged homeowners to come into compliance with the deed restrictions. The State of Texas has legally mandated the multiple steps the association must follow in the deed restriction enforcement process. The association has gone through every one of these steps with many homeowners, short of taking the homeowner to court to enforce the deed restrictions.
The Board prefers not to engage in legal action unless no other reasonable alternative is possible. The Board of the association sought to be responsive to the community on this matter, but 1) did not know if these were changes the community wanted and 2) did not have the authority to make the changes by itself. (Again, there is only one amendment process.)
To that end the PCA Board 1) temporarily froze the deed restriction enforcement process just before going to court with these homeowners and 2) scheduled a town hall meeting so the issue could be discussed by all members of the community. It was the hope of the Board that solutions to these matters could come from a community-wide discussion. No resolution was reached at that meeting.
After having a community-wide town hall meeting to discuss the issues and after sending two letters to each homeowner in the community about these matters, two amendments were put forward so that the community could decide if the deed restrictions should be changed. The proposed amendment on roof color would allow a homeowner to choose any roof color that the homeowner might desire and would not require approval from the community association. The proposed amendment on fence height would raise the maximum fence height at a residence from the current six-foot limit to six-feet and six inches.
As announced in the second letter to each homeowner, a community event was scheduled for Saturday, October 31 at the Mabry Mill Park and Pool area. The signature station was kept open from 9:00 am to 5:00 pm that day.
Results of the process are that both amendments failed by quite substantial amounts. The amendment on roof color received 122 out of a possible 2,282.258 signatures, or support from 5.35% of the community. Obviously, that was substantially below the minimum 75% required for approval. The amendment on fence height received 183 signatures, or support from 8.02% of the community. That was also substantially below the 75% requirement.
As a result of the defeat of the two proposed amendments, the deed restrictions in the Covenants relating to roof color and fence height are unchanged, and will continue to be enforced by the association. Those homeowners who have homes where the roof color and/or fence height are not in compliance, should bring their properties into compliance with the reaffirmed deed restrictions.
