Pineloch Homeowner's Annual Meeting September 30, 2003, 6:30 p.m. -- 9:00 p.m.

In accordance with Article III, Section III, of the By-Laws for the Pineloch Community Association, you are hereby notified of the annual meeting of owners to be held September 30, 2003, with registration beginning at 6:30 p.m. at Ward Elementary School.

The purpose of this meeting is to elect three new Directors to the Board of Directors, to present the annual update to the community of all progress during the current year, and to provide the most recent financial status report.

Proxies

If you cannot attend in person, your representation is still important.  To be represented at the meeting in your absence, please take a moment to fill out and return the proxy presented below to insure you will be represented in case something comes up at the last minute which may prevent you from attending.

In accordance with the Articles of Incorporation proxies will need to be notarized.  The Association's Property Manager, Ms. Kathy Dooley (Community Management Solutions, Inc. located at 2615 Bay Area Boulevard) will make available a notary public to notarize your proxy from 9:00 a.m. to 5:00 p.m. (or by appointment) Monday through Friday.

If your plans change and you are able to attend the meeting, your proxy will be voided when you sign in.  To insure a quorum (10% of the membership or approximately 200 members, including proxies) please take a moment and fill your proxy out right now -- while you are thinking of it!  If you do not have someone to represent you, you are more than welcome to assign your vote via proxy to any of the current Board Members, who are:

Election Details

This meeting is an annual event and there are three positions open on the Board of Directors.  Attached is a brief biographical summary written by each candidate for your review.  This information will also be included on the Association's web site at www.pineloch.org.  Voting at the meeting will be anonymous and by ballot only.  Proxies held by representatives will be exchanged for ballots during check in at the beginning of the meeting.

Again, the Association cannot transact any business at this meeting unless there is a quorum of 10% of the homeowners in attendance or represented by proxy.  All attendees must be in good standing to vote.  Nominations for Board positions will also be accepted from the floor the night of the meeting.

Wooden Fence Project

One of the most significant eyesores in the community is probably the appearance of the wooden fencing that backs up to the flood control ditches.  Many sections are leaning or look like they are about to fall down.  In an effort to improve the overall appearance of the community and to help with the cost of such a large project, the Pineloch Community Association has contacted several different vendors about the possibility of doing bulk fence replacements in the neighborhood.  The Association will handle coordination of the contact between the vendor and residents, Architectural Control Committee approval, and timing of construction.  The individual homeowner would be responsible for defining the specific sections of fencing to be replaced and for paying the contractor for the work done to their property.  Initial contractor response has been favorable, with several contractors quoting prices $1-2 per linear foot less than the general market rates.

Replacement fencing will be at standard six- foot height with dog- eared cedar pickets, treated pine posts and rails.  Posts will be a minimum of two feet into the ground.  Fence design modifications, other than the installation of a gate, will not be included in the project.  If you are interested in participating in a large group wooden fence replacement project, please contact CMSI at 281- 480- 2563.  We will need your name, address, and a general description of the work to be done (rear, sides, gate or no gate, etc.)  If you have any questions concerning the project, please ask for Kathy Dooley.

Falcon Flairs Dance Clinic

The Falcon Flair Drill Team will host their annual Flairs Dance Clinic on Saturday, November 15, 2003, from 9:00 a.m. until 2:00 p.m. in the commons area of the Clear Lake High School Ninth Grade Center.  The Flairs will offer dance instruction for students ages four through fifteen.  The cost of registration before November 7 is $25.00.  The price includes a T-shirt, midmorning snack and a drink to accompany your child's sack lunch.  Registration forms are available in the high school office or from your favorite Falcon Flair.  The cost of registration at the door will be $30.00.  For more information, please call Cheryl Carey at 281- 286- 5708.

Garden Treasures Fall Plant Sale

The Harris County Master Gardeners will hold their annual plant sale featuring perennials, heirlooms and Texas Native Plants for the Gulf Coast on Saturday, September 27, from 8:00 a.m. until 5:00 p.m. at the Clear Lake United Methodist Church, located at 16335 El Camino Real.  Also available at the sale: organic fertilizer, compost, tree stake kits, plant markers and more.  Join us throughout the day for free demonstrations on Low Volume Irrigation, Composting, Tree Planting, and Citrus Budding.  For additional information, call 281- 991- 8437 or email us at hcmgp2@earthlink.net.

Interfaith Caring Ministries Food Pantry Shelves Are Getting Bare

For hundreds of local families, food pantries provide assistance during times of need.  However, a recent increase in customers and a decrease in donations have caused a drain on our pantry.  We need your help!

Many of our clients work in the service industry, especially food service.  There are fewer people going out to eat as a result of layoffs in other industries, so many places do not need as many dishwashers or waitresses.  The trickle down is finally hitting the local economy.

Interfaith Caring Ministries in League City serves over 80 families a week and over 100 seniors a month.  With fall and winter just around the corner, we are concerned about our clients with children.  Our shelves are very low in many areas, and some sections are completely bare.  We have some action items that are in need immediately:

GREEN BEANS, PEAS, CORN, TOMATO SAUCE, CANNED MEATS (FOR EXAMPLE, TUNA, STEW, CHICKEN, SPAM, CHILI AND HAM), MACARONI AND CHEESE, SHAMPOO, TOOTHPASTE AND BRUSHES, CANNED MILK, JELL-O AND PUDDING MIXES, FEMININE PRODUCTS, TOILET PAPER, CEREAL, MISC. CANNED BEANS, CAKE MIXES, AND JELLY.

Our office is open Monday through Friday from 8:30 a.m. until 4:30 p.m.  Those interested in making donations can contact ICM Food Pantry at 281- 332- 3881 and talk to Kathy Moody.

Annual Community Garage Sale October 25th

The Pineloch Women's Association has set the date for the Annual Community Garage Sale for Saturday, October 25th.  They are planning to advertise the event in the paper and with signs on some of the main entrances.  If you want to participate, just put out a sign in the neighborhood directing traffic your way (good ones are available free upon request from many local realtors -- and don't forget to remove your signs promptly after the sale is finished!)  If you have any questions, contact Lynn Henry at 281-286-3159 or via email at gesslelm@netzero.net.

Candidates For The PCA Board Of Directors

Craig Domingues
I was born and raised in the Houston area and have lived in Clear Lake since I was fourteen years old.  I graduated from Clear Lake High School in 1982 and went on to attend college at Midland College.  After leaving college, I worked for NASA Space Center as a flight design analyst.  I left NASA to work for Transco Energy as a Natural Gas Transportation Analyst.  I am currently the Director of Tennis with Clear Lake Tennis and Director of the Elite TNT Tennis Academy located at San Jacinto College Central Campus.  I am also on the board of the Clear Lake High School Tennis Booster Club in charge of the facilities.

I am married and have six children.  My wife, Cyd, grew up in Clear Lake.  She attended school beginning at Whitcomb Elementary, then Clear Lake Intermediate, and graduated from Clear Lake High School in 1985.  She is currently living out her role as "Super Mom" raising our six children and taking care of their various extracurricular activities while also helping me out with my business.  She also is a board member for the Clear Lake High School Tennis Booster Club.

I have three daughters and three sons -- all of whom attend our local neighborhood schools.  My oldest daughter, Kayleigh, is fifteen and attends Clear Lake High School as a sophomore.  She is on the Varsity tennis team at the school.  Danielle is also fifteen and attends Clear Lake High School as a sophomore.  She is on the JV tennis team at Clear Lake.  Alex is the youngest of the girls -- in the eighth grade at Clear Lake Intermediate.  Jordan is in the fifth grade at Ward Elementary, followed by Ryan who is in the 4th grade at Ward.  The "baby" is Dustin.  He is four and goes to preschool at St. Bernadette's.

I am blessed to be able to work and raise my family in such a wonderful community.  I look forward to further serving our community as a board member of the community association!

Brian Ellis

Thank you very much for allowing me to be considered for a position on the board.  I believe that my business and managerial experience will assist the association and provide insight into the decision making process.  The continued prosperity of our neighborhoods is very important to me and I am prepared to assume a leadership role.

I have lived in the Bay Glen subdivision for 16 years.  I am married to Alice and have two children; Brittany, who is 16 years old and Brian, who is 14.  Both children are attending Clear Lake High School.  My wife and I are active in volunteer activities at the school.  We are parishioners of St. Bernadette Catholic Church and are active in the church community.  I am employed as a general sales manager for Bimbo Bakeries USA.  We are a $4 billion international baking company with brands such as Mrs. Bairds, Oroweat, Boboli, Entenmenns, Thomas, and Tia Rosa.  I have been with the company for 9 years.  My wife is in the mortgage business.  I am currently attending the University of Phoenix to complete my Bachelor's Degree in Business Administration.  I have attended San Jacinto College and the University of Texas.  I enjoy spending the majority of my time with my family.  My hobbies are reading, playing golf, and fishing.

Wally Holm

Born in Houston, Texas in 1957 -- please do not do the math!  Married twenty years to Karen Jamail Holm -- CCISD Elementary School teacher; children Ashley and Austin.

I grew up in the Spring Branch Memorial area known as Hedwig Village.  Even today, I remain in contact with my childhood friends that lived next door and down the street, most of who still live in town, and are part of life today.  If history repeats itself in this great community we live in, I believe the same will hold true for our children too.

Small town politics are no stranger to Wally Holm, whose dad was one of the original founding fathers that incorporated the area surrounded by Houston know as the Villages, consisting of Hedwig Village, Hunters Creek, Piney Point, and Spring Valley.  Having served in many capacities -- Street & Ditch committee, Councilman, Mayor, and Mayor-pro tem -- I have always been exposed to a strong since of community involvement.

Karen and I chose to move from Bellalre to Pineloch and start our family in 1989.  Clear Lake had everything we were looking for: good schools, recreation, and a developing community.  We built our house new in Pineloch and have remained here for 14 years.  Because we have such great neighbors here in Pineloch, it has been difficult to consider moving anywhere else.  It was great to live in a new community where everyone had so much in common.  I looked forward to getting involved by attending the PCA meetings, and volunteering as a Crime Watch Captain for my block.  Through the years, it has been a wonderful experience to raise our family here.  Nothing has given me more pleasure than participating at the local YMCA (Guides & Trails) programs with my children, and getting to go camping with them.

Today I am working as a Realtor at RE/MAX South Shore, partners in charity with the Children's Miracle Network.  More than selling homes and closing the deal, my commitment to improving the lives of children shows that I care about the community where I live and work.  As a Realtor, I believe that I can bring a unique perspective to the Board, and add value in a way that only someone in the real estate industry can.

You see, I visit every subdivision in the Bay Area everyday.  I know the tax rates and assessment fees of every neighborhood.  I get to see first hand what happens to an ageing neighborhood short of mishandled funds and lack of the right kind of leadership

I am counting on your vote to keep Pineloch at it's best.

James Simmons

My name is James Simmons, Sr.  I live at 14618 Oak Chase.  I am a native to the Southeast area.  I was born in Pasadena and lived here my entire life.  My wife Jan and I are charter members of PCA.  We chose to have our home built here in 1987.  We have been married for 30 years and have six boys and three girls, six of which are still at home.  Our family has been active in the PCA community and seen it grow over the past sixteen years.  We plan to retire here and wish to see the area maintain its beauty and value.

I graduated from South Houston High School and attended two years ofjunior college.  I have worked for Shell Oil Products Company in Deer Park for twenty- seven years.  I have advanced from a general helper to second line supervisor.  My last assignment was overseeing the maintenance for all the production units in the Hydroprocessing department.  I am currently serving as an operations team leader overseeing 64 operators and assisting the department manger.  I am comfortable in working with budgets, on teams, meeting time restraints, and overseeing people.  I fulfill my commitments.  My tenure with SOPC has more than developed the skills needed to serve our community association.

I have served on the pool committee for the past several years.  It is through this committee that I was unanimously appointed by the Board of Directors to fill the vacancy created by the resignation of a newly appointed board member.  I have served close to two years.  During this time, I have only missed one monthly meeting.  My main focus has been to get the amenities back into shape.  During my term there have been many items repaired.  The pool club houses and fences have been repaired and painted, the pools were drained and re- plastered, tile was added to the Oak Chase pool, rotten porch columns were replaced, all 12 pool pumps and motors were replaced, pool furniture was re-strapped, new emergency back boards were replaced, all park signs were replaced, a preventative maintenance checklist was developed and implemented, and the basketball goals were repaired and painted.  Two areas which need attention over the next year are the sidewalks and repairs to the concrete perimeter fence.  I firmly believe it is the Board of Directors' responsibility to set the example to homeowners by insuring the common areas comply with the bylaws, covenants, and deed restrictions the same as homeowners.

Please cast your vote for James Simmons, Sr. and allow me the opportunity to continue to serve on the PCA Board of Directors.  I will work to protect our property value.

John E. Thomassee

A resident of Pineloch for seven years, John graduated from Louisiana State University with a Bachelor's Degree in Electrical Engineering in 1995.  He works for Chevron Phillips Chemical as an Instrument, Electrical and Controls Engineering Manager.

John and his wife Tammie have a daughter Adrienne, age 12.  Tammie has been active in the classroom and PTA at John F. Ward Elementary, and is active in the PTA at Clear Lake Intermediate.  John has served the Pineloch Community Homeowner's Association for several years as a member of the Board of Directors, most recently as President of the Board of Directors.  John has again decided to seek a position on the Pineloch Community Association Board of Directors because he feels that he has a proven track record with the community, and he wants the Board of Directors to be more accessible to the people that comprise the Board's constituency.

New Operating Policies

As mentioned in the last issue of the Pineloch Perspective, your new Board of Directors (BOD) have developed and adopted an entirely new set of operating policies that are both consistent and compliant with the recent changes in State law.  These new policies will be followed by Management.  These policies, a total of fifteen, are posted on the Association's website located at www.Pineloch.org.

In this issue of the Pineloch Perspective, we have chosen to publish "Homeowner Communication with the Board of Directors" and "Homeowner Citing of Deed Restriction Violations".  As stated in the previous issue of the Perspective, the BOD's objective in publishing these policies is to ensure that our Association Members are aware that they exist and to provide them with a quick reference.

Homeowner Communication with the Board of Directors

Good communication can solve many problems and avert others.  Lack of communication or confusing communication can also create problems.  As your representatives on the Pineloch Community Association (PCA), the BOD encourages homeowner communication, but we also understand the need for consistency and clarity.  This involves understanding roles and responsibilities.  We believe in solving problems at the appropriate level.

The Association's Management Company representative, Kathy Dooley, is your first step.  She is responsible for inspection of the neighborhood, recording of violations, and sending out notices of deficiency or non- compliance.  Management is also the appropriate place to call about maintenance deficiencies, landscaping, and observed deed restriction violations.  This first step is to call 281- 480- 2563.  Record the time and with whom you talked or for whom you left a message.

The role of the BOD is to set policy, manage the budget, and manage the Management Company.  If you are not receiving the level of service you expect, it is appropriate that you inform the BOD.  There are a number of ways you can do that:

By doing this, you are assured that all BOD members are informed with the same information.  This is the consistency and clarity that we strive for in serving you to make our neighborhood a quality place to live and maintaining our home investment.

Homeowner Citing of Deed Restriction Violations

Remember, the enforcement of the Association's deed restriction covenants ensures that members' property values are maintained and that PCA families continue to live in a healthy and attractive community.  This policy addresses the enforcement of deed restrictions when the violation has been noted by a homeowner as opposed to the Management Company.


HOMEOWNER COMMUNICATION WITH THE BOARD

REVISION DATE: 12/19/02

PURPOSE

This policy addresses how PCA members may bring issues/ concerns to the attention of the Board of Directors (BOD) for resolution.

SCOPE

This policy applies to all members of the Pineloch Community Association, Inc., and all Lots which are subject to the Declaration of Covenants, Conditions and Restrictions for Bay Glen, Section One, a Subdivision in Harris County, Texas and any Amendments thereto (hereinafter sometimes "Pineloch Declarations") and the Architectural Control Committee (ACC) Guidelines (hereinafter collectively referred to as "governing documents").

REFERENCE(S)

The Declaration of Covenants, Conditions and Restrictions (DCCRs) as recorded in the Harris County Courthouse, Harris County, Texas, and any Amendments thereto (hereinafter sometimes "Pineloch Declarations") and the Architectural Control Committee (ACC) Guidelines.

POLICY

The purpose of the BOD is to enforce the Association's governing documents and to manage its assets.  To accomplish this goal, the BOD must establish policies stating succinctly how complaints about day-to day operations are to be addressed.  Should a PCA member have a concern or issue with the operation of the Association, they should initially try and resolve the issue with the Management company.  If after due diligence, the PCA member does not receive satisfaction from the Management company, the PCA member may address the BOD at their monthly meeting held on the 3rd Thursday of each month at 7 PM.  The Homeowner may learn the meeting location by reading the PCA website, the PCA Newsletter or by contacting the Management Company.

Near the outset of every BOD meeting, PCA members will be given an opportunity to address the BOD.  Typically, the BOD President will allow from 10-15 minutes of the meeting time to hear PCA member concerns.  The issues to be discussed during this time allotment shall not include Deed Restriction Hearings as required under the Texas Residential Property Act.  Discussions lasting longer than 5 minutes will be at the discretion of the BOD President.  Prior to addressing the BOD, the PCA member will be required to write their name, telephone number and address in a visitation book to be provided by the Management Company.  After the PCA Member has addressed the Board, the BOD may ask questions of the PCA member to better clarify the issue.  The Management Company will follow up with the PCA member before the next monthly meeting to advise them of how the BOD has decided to address their concern.


HOMEOWNER CITING OF DEED RESTRICTION VIOLATIONS

REVISION DATE: 11/21/02

PURPOSE

The enforcement of the Association's deed restriction covenants ensures that members' property values are maintained and that PCA families continue to live in a healthy and attractive community.  This policy addresses the enforcement of deed restrictions when the violation has been noted by a homeowner.

SCOPE

This policy applies to all members of the Pineloch Community Association, Inc., and all Lots which are subject to the Declaration of Covenants, Conditions and Restrictions for Bay Glen, Section One, a Subdivision in Harris County, Texas and any Amendments thereto (hereinafter sometimes "Pineloch Declarations"), including, but not limited to Bay Knoll, Section Two; Bay Knoll, Section Three; Bay Knoll, Section Five; Bay Knoll, Section Six; Bay Knoll, Section Seven; Bay Knoll, Section Eight; Bay Glen, Section Two; Bay Glen, Section Three; Bay Glen, Section Four; Bay Glen, Section Five; Bay Glen, Section Six; Bay Glen, Section Eight; and Bay Glen, Section Eleven.

POLICY

  1. Homeowner complaints regarding a violation of the Association DCCRs or ACC final guidelines may be called or emailed to the Property Management Company.

  2. Homeowner complaints regarding deed restrictions will be verified by the Property Management Company during their regular inspections of residential, commercial and Association common grounds for violations of the Association DCCRs and ACC final guidelines.  Upon verification of a deed restriction violation by the Property Management Company, a notice letter will be issued to the homeowner.

  3. Complaints regarding deed restrictions which can not be verified by the Property Management Company may be confirmed by a member of the Board of Directors (BOD).  If neither the Property Management Company nor the BOD can confirm the violation, the homeowner who registered the complaint will need to submit to the Property Management Company written verification from at least three (3) homeowners confirming the existence of a violation.

  4. Though initiated by another homeowner, as with all violation matters, the Association will follow the deed restriction policy to resolve any violation.

  5. Should the Association become involved in legal matters with a violator of any deed restrictions, those homeowners who initiated the complaints may be requested to testify on behalf of the Association.
